At Saleboat Tech  LLC, we are committed to maintaining the privacy of our Users and the information they entrust to us. We incorporate data protection principles throughout our Platform and Services that provide effective data privacy measures for our Users. We provide you this detailed Privacy Policy to advise you of the types of information we may gather about you when you use the Saleboat  Website, Platform or any of our Services, how we may use and disseminate that information in our agreements, and how you can control, correct and/or update the information. Depending on where you are located, you may have certain rights with respect to your personal information, which you can learn about below, along with how to exercise those rights. You may also close your account or request the deletion of all personal information we have about you at any time. However, closing your account or deleting your personal data may prevent you from using the Platform and/or Services.By accessing or using the Saleboat  Website (www.saleboat .com), Saleboat  Application, online services, mobile and other applications and social networking platforms (collectively, the "Platform"), you are accepting the policies and practices described in this Privacy Policy and our Terms and Conditions. Each time you use the Platform, you agree and expressly consent to our collection, use and disclosure of the information that you provide as described in this Privacy Policy.As used herein, the terms "we," "us," "our, or "Saleboat " mean Saleboat Tech  LLC and our affiliates. The terms "Users", "you", "your" mean the Freelancer and Client as defined and used in our Terms and Conditions.

In addition, Saleboat Tech LLC's use and transfer to any other app of information received from Google APIs will adhere to Google API Services User Data Policy, including the Limited Use requirements.

1. The Types of Information That May Be Collected By Saleboat

Saleboat  may collect information that can be used to identify you (“Identifying Personal Information”), such as your name and contact information (email address, physical address, landline/mobile phone number). We also may collect Device-Specific Information, such as your hardware model, operating system version, unique device identifiers, and mobile network information including phone number. We may associate your Device-Specific Information or phone number with your User Account. Depending on the nature of your inquiry or activities on the Platform, we may also ask for other information relevant to your use of the Platform.

When you register with Saleboat , create a User Profile and User Account, Saleboat  collects the following information about you: name and contact information (email address, business phone number, home phone number, cell phone number, residence address(es), financial information needed to make or receive payment for services obtained through the Platform, or information needed to fill out tax forms, information relating to your Payment Method (such as bank account number(s), credit card information, PayPal Account, ACH authorization, or the like); education, skills and work history. Saleboat  may also ask for examples of your work product. Your User Profile is updated to include updated information and additional information on work previously performed by you via the Saleboat  Platform (and possibly outside the Saleboat  Platform); hourly pay rates, feedback/rating information and other relevant information. Clients may also have the opportunity to create a Company Profile. We may also collect information related to your use of the Platform and use this information along with information about other users to helps us improve our services for you.

We collect credit card and/or bank account information and/or additional payment information from you. However, to protect your privacy we do not store any of this payment information or process any of your payments on our own servers. Instead, we use a third-party payment processor (which is subject to change at our sole discretion). The third-party payment processor may provide us with unique authentication tokens with which we must use to make payment requests and may also provide us with information such as your name, banking information, PayPal Account information, credit card type, expiration date, and the last four digits of your credit card number. This information is used only for the purposes of completing transactions you have initiated through the Platform, enrolling you in programs in which you elect to participate, protecting against or identifying possible fraudulent transactions, and otherwise as needed to manage our business.

Depending upon our relationship with you, we may collect the following categories and types of personal information from and about you:

Name, birth date, IP Address, Email Address, Home Address, Billing Address, Phone Number, Social Security Number, Driver’s License, State ID or Passport No., VAT ID No., Tax ID No. (Social Security No. or Employer ID No.), Citizenship and Immigration Status (for U.S. residents);
Transaction Data including services offered, considered, or purchased Credit card or other financial account information;
Unique device and app identifiers, browsing history or other usage data, the browser and operating system you are using, the URL or advertisement that referred you to the Service, the search terms you entered into a search engine that led you to the Service, areas within the Service that you visited, which links you clicked on, which pages or content you viewed and for how long, other similar information and statistics about your interactions, such as content response times, download errors and length of visits to certain pages and other information commonly shared when browsers communicate with websites;
Geolocation Data;
Audio recordings if you call our customer service or make calls in connection with the performance of a Service Contract with a Client, video recordings;
User-generated content, (e.g., community posts, feedback and job postings), photographs, examples of your work, information on work previously performed via the Service and outside the Service, skills, tests taken, test scores, hourly pay rates and earnings information;

When you use the Saleboat  Website and Platform, Saleboat  collects information based on your activities on the Website and Platform, such as: Transactional information based on your activities on the sites (such as bidding, Projects worked on/Clients worked for, and content you generate or that relates to your account), billing and other information you provide; (i) Project bidding; (ii) Projects worked on; (iii) content you generate or that relates to your User Account; (iv) billing and other information you provide; (v) personal information you provide to us through correspondence, chats, dispute resolution, or shared by you from other social media applications, services or websites; (vi) additional personal information we may ask you to submit to verify your identity for security purposes; (vii) information from your interaction with our Website, Platform, services, content and advertising, including, but not limited to, device ID, device type, location, geo-location information, computer and connection information, statistics on page views, traffic to and from the sites, ad data, IP address and standard web log information; (viii) non-personal information provided by third-party service providers (e.g. Google Analytics), and partners may receive and record non-personal information from cookies, server logs, and similar technology from your browser or mobile device, including your IP address.

We also collect information about Independent Contractors' work for Clients under a Service Contract. In order to automatically determine an Independent Contractor’s charges based on the actual work performed for a given Client, Saleboat  must gather information about that work from various third party platforms. We may collect information from third party email platforms and document generating/sharing platforms (such as Gmail, GSuite and/or Gmail Workspace) for work done on behalf of a Client, internet-based calling platforms (such as Ring Central, Zoom, and the like), such as number of inbound/outbound calls, length of calls, audio (and/or video) recordings of inbound/outbound calls, outcome of calls, interval between calls, downtime, third party tracking platforms (such as Hubspot), and other third party platforms on which Contractors may engage with actual or potential customers (such as Linkedin, Twilio, and the like). We may also used the Saleboat  Platform or third party platforms to collect information such as  keyboard strokes, mouse clicks, and periodic screenshots or video/snapshots of the Independent Contractor.

We collect information from the email and social media accounts of retrieving the GSuite data from the contractor accounts as well as getting a general report from the organization's admin GSuite account. With this information, we will then show a dashboard of the activity (including timestamps, duration, participants, etc.) to the Client of all their Contractor's activities on these third party platforms.

Some of the information collected may be aggregated. For instance, we may combine non-personal information with non-identifying personal information or identifying personal information. In such instances, we categorize the aggregated information as personal information if it contains sufficient identifying personal information to readily enable your identity or location to be determined.

We also may collect other types of information in the following ways when you visit and use our Platform:

  • Details of how you used the Platform, such as your search queries;
  • Telephone log information, such as your phone number, calling-party number;
    forwarding numbers, time and date of calls, duration of calls, SMS routing information and types of calls.
  • Device event information such as crashes, system activity, hardware settings, browser type, browser language, the date and time of your request and referral URL;
  • When you use a location-enabled service, we may collect and process information about your actual location, like GPS signals sent by a mobile device. We may also use various technologies to determine location, such as sensor data from your device that may, for example, provide information on nearby Wi-Fi access points and cell towers;
  • Our server logs automatically collect information, such as your IP address, your browser type and language, and the date and time of your visit, which helps us track Users’ movements around our Platform and understand trends;
  • We may assign your computer one or more cookies which may collect information to facilitate access to our Platform and to personalize your online experience. We use cookies, web beacons or similar technologies to enable us to customize our services and advertisements, analyze trends, administer the website, track users’ movement around the website, the desktop app, and the mobile app, and to gather demographic information about users. The technology used to collect information automatically from you may include cookies, web beacons, and embedded scripts. In addition, we and our partners, affiliates, analytics, and service providers may use a variety of other technologies (such as tags) that collect similar information for security and fraud detection purposes and we may use third parties to perform these services on our behalf;
  • We use third party analytics tools, such as Google Analytics, to collect and analyze certain User information and behavior. This information may include demographic and interest information, such as age, gender and users interests. We use this information for internal business purposes on an aggregated, anonymous basis.   • We may also collect certain information, such as the URL of the last web page you viewed before coming to our Website, your preferences and settings (e.g., time zone), the ads you clicked on or viewed on our Website or Platform (if any), how long you stayed on our Website or Platform and what services and features you used;

We collect all of the foregoing information directly from You or Your use of the Platform; Cookies and Other Tracking Technologies; Third Parties (such as affiliates, agents, service providers and other users).

We do not knowingly collect personal information from children under the age of 18. Should we ever do so, we will comply with the Children’s Online Privacy Protection Act. If you are under 18, you may use the Platform only with the direct involvement and through the Account of a parent or guardian.

We also may collect other information that does not identify you directly, such as zip codes, demographic data, information about your use of the Platform, and general project-related data, We may combine information collected from You, whether or not You are a registered User. In some cases, we may render Identifying Personal Information (generally, email address) into a form of Non-Identifying Information used to identify your activity and interests. We may also combine Identifying Personal Information and Non-Identifying Information, but Saleboat  will treat the combined information as Identifying Personal Information.

2. How Saleboat  May Use The Collected Information

Saleboat  shares information regarding Independent Contractors' status with current and past Clients of that Independent Contractor. Saleboat  also shares information regarding Independent Contractors' work with the relevant Client(s). The information shared includes information in status logs and work history with Clients.

If you choose to apply for work as an Independent Contractor via Saleboat , we will share information relevant to your ​application with the applicable Client(s), including, but not ​limited to, the information contained in your User Profile.

Saleboat  does not share any of your Identifying Personal Information or Transactional information with any person or entity, other than as set out in this Privacy Policy. No other third party receives your Identifying Personal Information or other transactional data, except when you choose to share it with third parties outside our control. Limited information about your physical location is also shared with third parties when you perform a search for local jobs on the Platform.

Saleboat may share the following data with Clients and third-party tools (such as AI models):

-       Name, Date of Birth, Social Media Account Information, Profile Data, IP Address, Email Address, Home Address, Billing Address, Phone Number, credit card or other financial account information, your approximate location, and transaction data including services offered, considered, or purchased, and work performed for Clients on the Platform. This information may be used for providing and improving our Platform, identification, communications, marketing, analytics, security, legal, compliance and regulatory requirements.

-   Social Security Number, Driver’s License, State Identification or Passport Number, VAT Identification Number, Tax Identification Number, Immigration Status, Citizenship Information. This information may be used for verifying your identity and detecting fraud, identity theft, or other misuse of your account, legal, compliance and regulatory requirements.

-   Unique device and app identifiers, browsing history or other usage data, the browser and operating system you are using, the URL or advertisement that referred you to the Service, the search terms you entered into a search engine that led you to the Service, areas within the Service that you visited, which links you clicked on, which pages or content you viewed and for how long, other similar information and statistics about your interactions, such as content response times, download errors and length of visits to certain pages and other information commonly shared when browsers communicate with websites.

Saleboat does not transfer user data to any of the following types of third parties or for any of the following purposes:

  • advertising platforms, data brokers, or any information resellers.
  • for serving ads, including retargeting, personalized or interest-based advertising.
  • Tto determine credit-worthiness or for lending purposes.

We use Identifying Personal Information and other data collected through the Platform to register you with Saleboat , and may use such information to provide you with information regarding employment opportunities, and to otherwise provide you with requested information or services. We may also from time to time use your Personal Information to send you automated email messages or marketing materials regarding our Services.

We also may use information to:

  • Improve and customize our services;
  • Send communications to you, issue newsletters to our  users, send marketing or promotional materials on behalf of Saleboat  or third parties, and make special offers; Offer products and services that may be of interest to you. If you decide that you do not want to receive such communications, you may discontinue receiving them by following the instructions in the Your Data Options Section below.
  • Process payment for services or products you order via our Platform;
  • Customize the advertising and content that you see on our Platform;
  • Facilitate use of our Platform, complete your transactions, address your inquiries, process your registration, verify the validity of information you provide, and for Saleboat  business purposes including but not limited to compliance and legal matters;
  • Manage your account and your preferences;
  • Analyze use of and improve our Platform, products and services;
  • Identify and protect against fraudulent transactions and other misuses of our Platform;

Enforce our Terms and Conditions

  1. To assess your proposal to perform an independent contractor project and prepare related governmental and internal statistics reports;
  2. To enforce and comply with the law, including to conduct an investigation, to protect the property and rights of Saleboat  or a third party, to protect the safety of the public or any person, or to prevent or stop activity we may consider to be, or to pose a risk of being, illegal, fraudulent, unethical or legally actionable activity. We may also use Device Identifiers to identify Saleboat  Users;
  3. For the purposes disclosed at the time you provide your information, with your consent, and as further described in this Privacy Policy;
  4. To Honor Our Contractual Commitments to You;
  5. For Our Legitimate Business Interests. In many cases, we handle Personal Information on the grounds that it furthers our legitimate interests in commercial activities, such as the following, in ways that are not overridden by the interests or fundamental rights and freedoms of the affected individuals:
  • Providing our Platform;
  • Detecting security incidents, protecting against malicious, deceptive, fraudulent or illegal activity, and prosecuting those responsible for that activity;
  • Measuring interest and engagement in our Platform;
  • Short-term, transient use, such as contextual customization of ads;
  • Improving, upgrading or enhancing our Platform and services;
  • Developing new products and services;
  • Ensuring internal quality control and safety;
  • Authenticating and verifying individual identities;
  • Debugging to identify and repair errors with our Platform and services;
  • Auditing relating to interactions, transactions and other compliance activities;
  • Enforcing our agreements and policies;
  • Analyzing and improving our business;
  • Communications, including marketing and responding to your inquiries about our services.
  • Addressing information security needs and protecting our Users, Saleboat , and others;
  • Managing legal issues.

    Furthermore, we may make your User Profile visible to all Saleboat  Users and the general public. You may edit certain information in your User Profile and we may enable you to choose to limit who is able to view certain content you post to your User Profile and to limit viewing of your User Profile only by Saleboat  Users.

    If, in any case, you believe that an unauthorized profile has been created about you, you can request for it to be removed by contacting us at: support@saleboat .com

3. Data Retention

Unless you request that we delete certain information (see Your Data Options below), we will only retain your Identifying Personal Information for as long as is necessary to fulfill the purposes for which it was collected, including while you are a user of the Platform and until you advise us that you will no longer use the Platform, for the purposes of satisfying any legal, regulatory, accounting, or reporting requirements, as well as ongoing fraud prevention, backup, and business continuity purposes.

4. With Whom We May Share Information We Collect

We will not share your personal information with others except as indicated in this Privacy Policy, or except when we inform you in advance and give you the opportunity to opt out.

We may use third-party information on our Platform for the purposes understanding how you interact with our Platform.We may also share information collected about you, including Identifying Personal Information, as disclosed at the time you provide your information, with your consent, as otherwise described in this Privacy Policy, or for the following business or commercial purposes:

  • Independent Contractors who have entered into a contract with an Saleboat  Client authorize Saleboat  to share their Personal Identifying Information with such Clients and payroll vendors. For Independent Contractors who choose to view a job post or submit a proposal via the Platform, we may share their information with the applicable Client(s). For Independent Contractors who have made their profiles publicly visible, we may share their information with Clients, Agencies, Partners, and Developers.
  • If an Independent Contractor is suspended from the Platform, we may share that information with Clients for whom that Independent Contractor has worked or submitted proposals for work.
  • For Clients who have entered into a service contract with another user, we may share your information in order to complete the transaction or to facilitate the resolution of a claim or dispute. The user receiving your information is not allowed to use it for purposes unrelated to the transaction.
  • We may employ third-parties to facilitate our Platform and services, to host the Platform, to perform related services including but not limited to maintenance services, database management, web analytics and online advertising, payment processing, fraud detection and improvement of Saleboat  features, or to assist us in analyzing how our Platform is used. These third parties may include analytics companies, advertising partners, payment processors, identity verification companies, security companies, or other merchants. These third parties may have access to your Identifying Personal Information in order to perform these tasks on our behalf.
  • We may enhance certain features of our Platform and service by relying on artificial intelligence (“AI”) provided by third-party AI service providers. We may share the information you provide while using these features with these AI service providers, as well as additional information necessary to utilize AI  features.
  • We will share information with government and law enforcement agencies in response to lawful requests and to satisfy reporting requirements. We will cooperate with government and law enforcement and private parties charged with enforcement and compliance with the law, including disclosing information about you to government or law enforcement officials or private parties as we deem appropriate to respond to claims and legal process or at the request of governmental authorities or other third parties conducting an investigation where we deem the disclosure to be appropriate to protect the property and rights of any person or entity, to protect public or individual safety, or to prevent or cease activity we may consider to be, or pose a risk of being, illegal, fraudulent, unethical or legally actionable.
  • We may share Identifying Personal Information and Non-Identifying Information with any of our parent company(ies) or any subsidiary(ies) or affiliate(s) for business purposes, including activities such as IT management, for them to provide services to you, or support and supplement the Services we provide. We may sell, transfer, or otherwise share some or all of our assets, including your Identifying Personal Information, in connection with a merger, acquisition, reorganization or sale of assets (including, in each case, as part of the due-diligence process with any potential acquiring entity) or in the event of bankruptcy.

We may share Identifying Personal Information with:

  • Businesses in connection with your direct customer service inquiries and/or requests;
  • Service providers, such as credit-card payment processors, performing services on our behalf;
  • Other businesses with which we partner or which we carefully select to offer you products, services, and promotions through our Platform or offline; and
  • Other third parties in limited circumstances, such as reporting suspected criminal activity, complying with legal requirements, preventing fraud, and protecting the safety of our users.

    We may share aggregated, anonymous information for our own marketing purposes and for purposes of improving the manner in which, and to whom, we offer our services.

5. Your Data Options

You may have certain rights associated with your Identifying Personal Information, including the right to opt out of targeted advertising. Residents of certain locations may have the right to have an authorized agent submit requests on your behalf.

You or your authorized agent may request Saleboat  to honor these rights by contacting us as outlined in the “Contact Us” section below.

Non-Discrimination: You will not receive any discriminatory treatment by us for the exercise of your privacy rights. Verifying Your Request: Only you or a person that is authorized by you to act on your behalf may make a request related to your Identifying Personal Information. In the case of access and deletion, your request must be verifiable before we can fulfill it. To verify your request, we will require you to provide information sufficient for us to verify that you are the person about whom we collected personal information, or a person authorized to act on your behalf. We will only use the personal information that you provide in making such a request in order to verify your request. We may charge a reasonable fee or refuse to act on a request if such request is excessive, repetitive or unfounded.

You may choose:

  • Not to provide personal information, although that will result in your inability to obtain certain services or use certain features of our Platform;
  • To stop receiving promotional emails or newsletters from us by sending an email to: support@saleboat .com;
  • To delete or decline cookies by changing your browser settings, although if you do so, some of the features or services of our Platform may not function properly or at all;
    To review and update your personal information by sending us an email at support@saleboat .com requesting to review your personal information or, if you have an account on our Platform, by logging into that account.
  • You may opt-out of any Google Analytics-related collection by visiting the following App and following the opt-out procedures: https://tools.google.com/dlpage/gaoptout/.

For Individuals Located in the European Economic Area (EEA), United Kingdom (UK), or Switzerland:

The General Data Protection Regulation (GDPR) is a data privacy law that gives residents of the European Union (“EU”) more clarity and control over how their personal data is used. Personal data is anything that can directly or indirectly identify a person, such as a photo, name, bank details, medical information, computer IP address, and so on.

Under the GDPR, companies are required to be transparent about what types of personal data they collect and how they use it, be responsible for secure data processing practices, and provide notification to customers or data subjects when breaches occur.

The United Kingdom General Data Protection Regulation (UK GDPR) is a UK law that is largely based on the GDPR, but went into effect in 2021 as a result of the UK’s withdrawal from the EU. In conjunction with the Data Protection Act 2018, it sets out the key principles, rights and obligations for most processing of personal data in the UK.

The Digital Services Act (DSA) is a European law that aims to ensure a safe and accountable online environment that went into effect November 16, 2022.

With respect to transfers that involve personal data that is within the scope of European data protection laws, Saleboat  relies on standard contractual clauses as a transfer mechanism to reflect relevant compliance requirements.

You have a number of rights under applicable data protection laws in relation to your personal information. Under certain circumstances, you have the right to:

Have access to your personal information by submitting a request to us;
Have your personal information deleted;
Have your personal information corrected if it is wrong;
Have the processing of your personal information restricted;
Object to further processing of your personal information, including to object to marketing from us;
Make a data portability request;
Withdraw any consent you have provided to us;
Restrict any automatic processing of your personal information;
Complain to the appropriate Supervisory Authority.

For Individuals Located in the United States

There are various data protection regulations and laws in various states which Saleboat  is monitoring on an ongoing basis Some state laws provide individuals with the right to prevent the sharing and sale of personal information. Saleboat  does not sell your personal information. Some state laws allow individuals to limit the use of their sensitive personal information to purposes necessary to perform the services. Saleboat  complies with this requirement.

Notice for California Residents

Residents of the State of California may request a list of all third parties to which Saleboat  has disclosed certain information during the preceding twelve months for those third parties’ direct marketing purposes.

California Consumer Privacy Act (CCPA)/California Privacy Rights Act (CPRA): The CCPA, as amended by the CPRA, provides California residents and/or their authorized agents with specific rights regarding the collection and processing of their personal information. These rights include the right to know, the right to opt out of the sharing or sale of personal information, the right to limit the use of sensitive personal information, the right to correct, the right to delete, and non-discrimination rights. These rights are outlined below:

The Right to Know: California residents have the right to request that we disclose the following information to you about our collection and use of your personal information over the past twelve (12) months. We may ask you to provide certain information to identify yourself so that we may compare it with our records in order to verify your request. Upon verification, we will disclose to you:

  1. The categories of personal information we have collected about you.
  2. The categories of sources for the personal information we have collected about you.
  3. The specific pieces of personal information we have collected about you.
  4. Our business or commercial purpose for collecting or selling your personal information as defined by the CCPA.
  5. The categories of third parties to whom we have sold or shared your personal information, if any, and the categories of personal information that we have shared with each third-party recipient.

The Right to Opt-Out of “Sale” or “Sharing” of Personal Information: California residents have the right to opt-out of the sale or sharing of their personal information as defined by the CCPA by contacting us using the information in the “Contact Us” section below.

Please note that we do not sell any personal information of individuals under the age of 18. Where we are sharing your personal information with third parties for the purposes of advertising or profiling, you may opt-out of such sharing at any time by contacting us using the information in the “Contact Us” section below.

The Right to Limit Use of Sensitive Personal Information: California residents may have the right to request that businesses limit the use of any sensitive personal information to those uses which are necessary to perform the Services or for other specifically-enumerated business purposes under the CCPA, as amended by the CPRA. Please note that we do not use sensitive personal information other than as necessary to perform the Services or as specifically permitted under the CCPA.

Your Right to Delete: California residents have the right to request that we delete any of the personal information collected from you and retained by us, subject to certain exceptions. We may ask you to provide certain information to identify yourself so that we may compare it with our records in order to verify your request. Once your request is verified and we have determined that we are required to delete the requested personal information in accordance with the CCPA, we will delete, and direct our third-party service provides to delete, your personal information from their records. Your request to delete personal information that we have collected may be denied if we conclude it is necessary for us to retain such personal information under one or more of the exceptions listed in the CCPA.

Your Right to Correct: Under the CCPA, as amended by the CPRA, California residents have the right to request that we correct any inaccurate personal information we maintain about you, taking into account the nature of the personal information and the purposes for which we are processing such personal information. We will use commercially reasonable efforts to correct such inaccurate personal information about you.

Non-Discrimination: You will not receive any discriminatory treatment by us for the exercise of your privacy rights conferred by the CCPA.

Notice for Nevada Residents

Under Nevada law, certain Nevada residents may opt out of the sale of “Personally Identifable Information” for monetary consideration to a person for that person to license or sell such information to additional persons. “Personally identifiable information” includes first and last name, address, email address, phone number, Social Security Number, or an identifier that allows a specific person to be contacted either physically or online. Saleboat  does not engage in such activity; however, if you are a Nevada resident who has purchased or leased goods or services from Saleboat , you may submit a request to opt out of any potential future sales under Nevada law by contacting us as outlined in the “Contact Us” section below. Please note we will take reasonable steps to verify your identity and the authenticity of the request. Once verified, we will process your request.

Notice for Residents of Certain Other States
